Topic: Worldwide, over 1.5 million patent applications are filed annually. Librarians increasingly face questions, not only about patenting in the United States, but about seeking intellectual property protection in other countries. This panel presentation addresses issues faced by inventors seeking international markets, extending patent searching to include international documents, and using the Esp@cenet database to search and retrieve international patents.

Don Kelly, Advising Inventors Bound for Global Markets: “It’s a Long and Hazardous Swim for the Ill-prepared.”
| Abstract: “Do I need an international patent, or does my current US patent cover the world?” How many of us struggle with such questions from entrepreneurs? How can one convey even a basic appreciation of international IP protection – – its nuances, redundancies, vagaries and absolutes? Maintaining “library stacks” of timely information pertinent to domestic IP is challenging enough for frontline assistance providers. Now, the buzz word is globalization, and most of us find ourselves with new “professional development opportunities.” There is no end to the information that typical frontline assistance providers must stuff their minds with in order to advise inventors who are doggedly intent on chasing international markets. Being adequately prepared for every question is impossible. However, we must be ready to offer advice that covers at least the key failure points. This paper offers crucial advice on those points – – steps to be taken by all inventors from the earliest phase of invention development. |
Don Kelly is founder of the Alexandria, VA based firm, Intellectual Asset Management Associates (IAMA), LLC. IAMA and its affiliates offer full service patent prosecution, intellectual property consultation and executive training, specializing in entrepreneurial firms and independent inventors. Author and frequent lecturer on IP issues and American innovation, Kelly has served as adjunct professor at Franklin Pierce Law Center and currently lectures at the USDA Graduate School’s International Institute and the Asian Pacific Legal Institute. Recently, he was named executive director of the New York based Rothschild Patent Model Museum & Invention Center. Joining the patent examining corps with a BS in mechanical engineering and extensive study in aerospace engineering (VA Tech), Kelly served a distinguished public service career that spanned 36 years. He was a patent examining group director for more than a dozen of those years, and also served as senior executive staff for two Commissioners. While with the USPTO, Don Kelly was the principal architect of the educational outreach initiative called Project XL, and the founding director of the Office of Independent Inventor Programs. Kelly left public service in 2000 to head the educational non-profit Academy of Applied Science, Inc, subsequently establishing IAMA in spring of 2002. Kelly sits on the corporate board of Patent Café, Inc. as well as the advisory board of the Washington, DC based IP think tank, International Intellectual Property Institute, Inc. and the newly established ByKidsForKids, Inc. He chairs the Intellectual Property Owners (IPO) Association’s Small Entities Committee, and is co-founder and advisor to the United Inventors Association. Co-author of Inventor’s Master Plan, Kelly’s writings also appear in a variety of other publications including: Stand Alone, Inventor; Inventors Digest Magazine; American Heritage of Invention and Technology; The Inventor’s Bible; Export America; From Patent to Profit; The Complete Idiot’s Guide to Cashing in on Your Inventions; Journal of the Patent and Trademark Office Society.
Jan Comfort, Beyond the Basics: Expanding the Results of a Preliminary Patent Search
Jan Comfort is the Government Documents Reference Librarian at the R.M. Cooper Library at Clemson University in Clemson, South Carolina. Prior to coming to Clemson in 1992, Jan split her time between the Bevier Engineering Library at the University of Pittsburgh and the Science and Technology Department at the Carnegie Library. Patents have always been a part of her responsibilities, and she is particularly interested in historic patents training aspects of the patent and trademark collections and databases. Jan is active in several professional organizations, including PTDLA, the Patent and Trademark Depository Library Association, for which she has recently been elected Secretary. When she is not working, Jan enjoys cooking, gardening and boating. She lives on beautiful Lake Hartwell with her husband and four cats.
Jason Martin, The Wide World of Esp@cenet
Jason Martin received both his BA in history and his MLS from the University of South Florida. He is a reference librarian at the University of Central Florida. Mr. Martin is a noted bon vivant and spends his free time hob-knobbing with the intelligentsia of the supermodel crowd.
